For clarity, you retain all of your ownership rights in your User Submissions. You also hereby grant each user of the YouTube Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service. As long as the quality is equal or worse what you can get through the hak.5 site I don't see it as that big a deal that they can do whatever they want with it. Just point out in the movie that you can get this stuff (in better quality) for free at the hak.5 website. If anyone did end up paying for whatever YouTube dreamed up, they'd feel fucked since they would realise they could've gotten it easily for free.
